Terms and Conditions

All sales made by Debbie Gillespie Cake Design are subject to the following terms and conditions. Nothing contained within these terms and conditions affects your statutory rights as a consumer. Please read the following terms and conditions. If there is anything you don’t understand, please feel free to contact us.


The price for the order shall be as stated on your order form. You agree to pay the full price to Debbie Gillespie Cake Design in accordance with this order form after the details have been checked and agreed by you.


All cake orders require a non-refundable deposit of 25% of the total cost. Deposits become due when the order details have been agreed and signed off by you. All orders are deemed to have been accepted only when the deposit has been paid. Payment of the deposit indicates that you accept these Terms and Conditions.


Payments can be made by BACS transfer. Barclays Bank, Account No. 10905690 Sort Code. 20-94-48 As a reference please use customer name. Payments can also be made by cash or cheque. An e-mail notification will be sent when payments are received and funds cleared.

Final Payments

Final payments for wedding cakes are due 14 days prior to the wedding date. For all other orders, final payment is due on collection/delivery or as stated on your order form.


In the event that any payment is subsequently declined, the order will not be completed or released until alternative funding arrangements have been agreed and payment is made in full. Subsequent completion of the order will be subject to availability and cannot be guaranteed. Debbie Gillespie Cake Design accepts no responsibility for any loss howsoever caused or for non-delivery under these circumstances. The customer will be responsible for the payment of any additional changes which have been incurred as a result of payment failure.

Alterations to order

Your cake is very important to us. Please take the time to check your copy of the order form carefully and let us know of any alterations immediately, prior to signing off and payment of deposit. It is your responsibility to advise Debbie Gillespie Cake Design of any alterations to the original order. We reserve the right to increase a quoted fee in the event that the customer requests a variation to the work agreed. Whilst every effort will be made to assist, please note that late changes cannot always be guaranteed.

Cake component parts

From time to time certain materials may become obsolete or no longer be available from our suppliers, e.g. specific ribbon colours. This is totally out of our control, however we will endeavour to re-design a cake to reflect as closely as possible the original design using replacement products. In all cases, we will try to contact you to advise you of any such changes.

Some inedible items e.g. wires, posy picks etc, may form part of the cake design. The customer will be made fully aware of their presence and must ensure that all such parts are removed prior to serving. Debbie Gillespie Cake Design cannot accept any responsibility for injury sustained from these items, nor for any damage caused by non-edible items applied to the cake by a third party e.g. floristry wires, real flowers etc.


Your order may be collected from the above address at a pre-arranged, mutually convenient time. A signature may be required upon collection confirming that you have received your order in good condition and as specified.


Delivery will be by prior arrangement. If you have a specific delivery date/time, please specify this when placing your order. We will do our best to accommodate your requirements.

It is the customer’s responsibility to ensure that correct delivery information is provided and that someone is available to receive your cake. A signature will be required for the receipt of the order upon delivery.

If the recipient is not in, the order will be returned to Debbie Gillespie Cake Design who will contact you to arrange an alternative delivery time for which an additional change will be payable by the customer. Debbie Gillespie Cake Design accepts no responsibility for any loss or consequential loss incurred by the customer as a result, e.g. a wedding without a wedding cake.

We are able to offer free delivery within the Huddersfield area (i.e. a 15-mile radius from Farnley Tyas). For deliveries outside of this area, a charge of 60p per extra mile will be made, with distances used as calculated by satnav. The customer will be notified of these charges on placing the order.

Setting up

Should you require your cake to be delivered, Debbie Gillespie Cake Design will deliver and set up your cake as agreed and will want to ensure it is displayed at its best. It is your responsibility to ensure that you have provided us with the set-up details and arrangements made with the venue for the location and display of your cake. Debbie Gillespie Cake Design cannot be held responsible for the location of your cake at the venue. Please ensure, therefore, that the display location is level, stable and strong enough to hold the cake.

Please also remember that chocolate-covered cakes can melt in warm conditions such as inside a marquee on a hot summer’s day, or when set up in direct sunlight.

Once the cake has been collected or delivered, set up and signed for, Debbie Gillespie Cake Design is unable to accept liability for any interference with or damage to the cake thereafter.

If a cake is to be delivered and set up by us, a signature will be required from your venue management confirming that the cake has been received and set up in good condition. A photograph of the cake will be taken prior to our departure to verify that the cake has been set up and left in good condition.

Cancellations / refunds

As your wedding/special order booking is reserved solely for you and certain components for your cake may be ordered months in advance, the following conditions are implemented when an order is cancelled:

0 – 2 weeks from delivery date: 100% of total cost payable
2 weeks – 3 months: 50% of total cost payable
3 months onwards: Loss of deposit

Cake stand hire

We have a selection of cake stands that can be hired for your function for £10. A £50 damage deposit is also required, which is fully refunded once the stand is safely returned within 1 week. However, should this hire period be exceeded, a £10 charge will be made for every week outstanding regardless of return (unless alternative arrangements have been made). It is the customer’s responsibility to return the stand to Debbie Gillespie Cake Design (unless previous arrangements have been made). Should a stand be left at a venue, a collection fee may be required.


Please note that no person shall have entitlement to copy or reproduce in any form, or otherwise make use of any original image, photograph, design or other item produced by or on behalf of Debbie Gillespie Cake Design without prior written consent.

Publication and promotional rights

By paying the deposit, the customer agrees that Debbie Gillespie Cake Design is the sole designer and owner of the final cake design. All rights in any original designs created and designed by Debbie Gillespie Cake Design shall remain the exclusive property of Debbie Gillespie Cake Design. From time to time our designs may be published in the media e.g. wedding magazines, website etc. We reserve the right to use any image of a customer’s cake made by us for publication after the delivery date unless previously agreed in writing between the customer and Debbie Gillespie Cake Design. Please be assured, however, that no design will appear on social media prior to the customer’s viewing i.e. before the wedding/birthday.

The customer has no ownership rights over any cake design. Exclusivity of cake designs between our customers is not guaranteed unless the customer commissions an exclusive design.


Viewings can be pre-arranged for wedding cakes. However, cakes with sponge tiers may not be completed until the day prior to or the day of the celebration to ensure the cakes are as fresh as possible.


Please be aware that whilst your chosen cake may not be made with nuts or a nut product, it will be prepared in a kitchen where nut products may be used in other cakes and fillings.  Specific dietary requirements can be catered for on request.  However, as your cake has been prepared in a kitchen where allergens may be present, cross-contamination will be avoided, but cannot be fully eliminated.

You/your venue will be provided with a printed information sheet, stating the allergens present in each cake.  Unless previously agreed, our cakes will routinely contain eggs, milk and gluten.
